Terms of Service

Welcome to GrowNotes, a mobile application designed to help you manage and journal your garden activities. By using GrowNotes, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully.

1. Acceptance of Terms

By creating an account or using the GrowNotes app, you agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use the app.

2. User Accounts

  • Account Creation: Users must create an account to access GrowNotes' features. Your account allows you to store data, including notes, photos, and other garden-related content.

  • Account Security: You are responsible for maintaining the confidentiality of your login information and for all activities under your account. Please notify us immediately if you suspect any unauthorized access to your account.

3. User Content

  • Ownership: You retain full ownership of all content you upload to GrowNotes, including notes, photos, and other personal data.

  • Privacy: Your content is private and will not be shared with third parties unless you explicitly choose to do so. GrowNotes does not publicly share your content without your permission.

  • Acceptable Use: You agree to use GrowNotes only for lawful purposes and in accordance with these Terms. You will not misuse the app, interfere with its operation, attempt unauthorized access, or use the app to upload or transmit unlawful, harmful, or infringing content.

  • License to Operate the Service: You grant GrowNotes a limited, non-exclusive, worldwide license to host, store, process, reproduce, and display your content solely to operate, maintain, and improve the app and provide the services (including syncing and backup). This license ends when your content is deleted from the service, except to the extent we must retain it for legal, security, or backup purposes.

  • App Ownership. GrowNotes and all related software, features, design, branding, logos, and functionality (excluding user content) are owned by GrowNotes and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works from the app except as permitted by law.

4. Data Storage and Security

  • Cloud Storage: Your data is securely stored in cloud storage services. We implement reasonable measures to protect your data but cannot guarantee absolute security.

  • Analytics: We collect app usage data to improve our services and features. This data is anonymized and does not include personal content or data.

5. Premium Features, Subscriptions, and Payments

 

5.1 Pro Subscription. GrowNotes offers optional paid subscriptions (“GrowNotes Pro”) that unlock premium features. Subscription features may change over time, and we may add, remove, or modify Pro features at any time.

5.2 In-App Purchases via Apple. If you purchase GrowNotes Pro through the Apple App Store, payment will be charged to your Apple ID account at confirmation of purchase.

​

5.3 Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Managing and Canceling. You can manage or cancel your subscription in your Apple Account settings (iOS: Settings → Apple ID → Subscriptions). Deleting the app does not cancel your subscription.

 

5.5 Price Changes. Subscription pricing may change. Where required, we will provide notice and/or request consent through the App Store mechanisms before a price change takes effect.

 

5.6 Refunds. Refund requests are handled by Apple, not GrowNotes. To request a refund, use Apple’s refund request process.

 

5.7 Trials and Promotions (if applicable). If we offer a free trial or promotional pricing, eligibility and duration will be disclosed at sign-up. If you do not cancel before the trial ends, you will be charged the subscription price and the subscription will auto-renew unless canceled.

 

5.8 Access After Cancellation or Expiration. If your subscription ends, you will retain access to free features. Some Pro features may be restricted, and certain Pro-only functionality may no longer be available.

 

5.9 Restore Purchases. If supported in the app, you may restore eligible purchases using the “Restore Purchases” function.

6. Push Notifications and Reminders

If you enable reminders or notifications, GrowNotes may send push notifications to your device. You can disable notifications at any time through your device settings. Notification delivery depends on your device, operating system, and notification settings, and we do not guarantee delivery at a specific time.

7. Disclaimers and Limitation of Liability

7.1 Service Provided “As Is.” GrowNotes is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee that the app will be uninterrupted, error-free, or free of harmful components.

7.2 Data Loss. While we strive to provide a reliable service, GrowNotes may experience bugs, outages, or technical issues that could result in data loss. You are responsible for maintaining your own backups of important information. We are not liable for lost data or resulting damages.

 

7.3 User Responsibility. You are solely responsible for the content you upload and for how you use the app and any AI-generated output. We are not liable for any claims arising from your content, including intellectual property claims.

 

7.4 Security Incidents. Although we implement reasonable security safeguards, no system is completely secure. We are not liable for unauthorized access, hacking, data breaches, or other malicious acts beyond our reasonable control.

 

7.5 Limitation of Liability. To the maximum extent permitted by law, GrowNotes and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption. Our total liability for any claim arising out of or relating to the app shall not exceed the amount you paid to GrowNotes in the twelve (12) months preceding the claim.

8. AI Features

GrowNotes may provide AI-powered features (for example, growing tips and plant name suggestions). AI output may be inaccurate, incomplete, or not suitable for your situation. AI features are provided for informational purposes only and are not professional agricultural, horticultural, medical, or safety advice. You are responsible for how you use AI output and for verifying information before taking action.

9. Modifications to Terms of Service

  • Updates: We may update these Terms of Service from time to time. Updates will be included with app updates, and users will be notified of significant changes. Updates are generally infrequent and may occur when new features, such as AI, are introduced.

10. Termination of Service

  • Suspension or Termination: We reserve the right to suspend or terminate your account if we detect any malicious or suspicious activity. Terminated accounts will be deleted after 90 days unless you can demonstrate that your account was compromised and recover your access.

11. Governing Law

These terms are governed by the laws of Massachusetts in the United States. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Massachusetts.
